The official site has reported on a new U.S. appeals court ruling out of the 4th District Court of Appeals upholding a Federal judge's decision that satellite carriers must carry all or none of a local area's broadcast channels. Referred to as the "carry one, carry all" rule, this means that starting January 1, 2002, satellite carriers that selectively carry local channels in some markets will have to either pick them all up or drop them completely.
Judge Blane Michaels wrote in his opinion, "We hold, as did the district court, that the 'carry one, carry all' rule does not violate either the First Amendment or the other constitutional provisions cited by the satellite carriers,'' clearly stating that it is the pervue of the courts to ensure that local broadcast programming is available to all Americans. The Media Access Project agrees, it's president Andrew Schwartzman saying "The court has again confirmed the government's power to protect the viewing public and to insure that local broadcasting is available to all American citizens."
Meanwhile, one satellite provider, EchoStar, which currently carries local channels in 36 markets, told Reuters "At this point, we have no plans to drop any local markets."
The official site does mention that while this decision may not help TREK fans who live in markets where no UPN affiliate exists, it does mean that satellite customers in markets with affiliates could soon be seeing ENTERPRISE. One example is the moderately large market of Orlando, Florida; while there is a long-established UPN affiliate here, Direct TV does not carry it currently. With this ruling, Direct TV customers in Orlando may be able to see ENTERPRISE come January.
